Terms of Service

These Terms of Service (“Terms”) are a contract between you and EstateSaleFinder LLC (“Company,” “we,” “us”), a Florida limited liability company, about your use of Sell My Stuff For Me at sellmystuffforme.com and related pages, apps, and emails (the “Service”).
By creating an account, tapping a specialty, posting items, listing as a seller, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Please also read our Legal page, which explains the same ideas in shorter form.
1. What the Service is — and is not
The Service is an online directory and introduction tool. Households describe items they want sold. Independent sellers who pay a listing subscription may appear in search. We do not buy, take possession of, store, ship, auction, or consign goods. We do not process payment for goods. We do not take a commission or percentage of what sells. We are not an auctioneer, auction business, consignment shop, secondhand dealer, broker, marketplace for goods, or the employer or agent of any seller.
Any arrangement to pick up, list, sell, donate, or return items, and any money that changes hands for those items, is solely between the household and the seller. We are not a party to that arrangement and have no obligation to enforce it.
2. Eligibility and accounts
You must be at least 18 years old and able to form a contract. You are responsible for your login and for activity under your account. Provide accurate information. We may refuse, suspend, or close an account at any time, including if we believe these Terms were broken.
3. If you have stuff to sell (households)
You represent that:
- you own the items, or you have legal authority to sell them (including as personal representative of an estate, where that applies);
- the items are not stolen, counterfeit, or offered in violation of law;
- you will not list firearms, ammunition, explosives, recalled children’s products, or other items we prohibit;
- descriptions you post are truthful to the best of your knowledge.
Posting a request does not require any seller to take your items. You should get the deal in writing with the seller before anything leaves the house. We do not guarantee that anyone will respond, sell, or pay you.
4. If you list as a seller
A seller listing is a paid subscription for visibility on the directory. It is not employment, a franchise, a joint venture, or a promise of leads. You are an independent business. You decide whether to take a job, what to charge, and how to sell.
You represent and agree that:
- you will obtain and keep every license, permit, bond, and tax registration required for the way you actually sell (including, if applicable, a Florida auctioneer or auction-business license, secondhand-dealer or consignment registration, local business tax, and sales-tax collection);
- you will use a written agreement with each household covering title, commission, unsold items, damage, and payout;
- you will not hold yourself out as employed by, partnered with, or acting for EstateSaleFinder LLC;
- your profile (commission, specialties, radius, pickup, minimums) is accurate;
- you will not sell prohibited items, stolen goods, or goods you do not have the right to sell;
- you are responsible for your own insurance.
We may ask for license numbers or other confirmation. Asking is not a representation that we verified you, bonded you, or background-checked you, unless a specific badge on your profile says exactly what we checked.
5. Fees, Featured listings, and refunds
Households do not pay us to look or to send a request. Sellers pay a monthly listing fee (currently $29 Listed or $49 Featured). Fees may change with notice. Subscriptions are for directory placement only. We do not guarantee inquiries, hires, or revenue.
Featured is paid advertising. Featured sellers may be sorted above others. That placement is not a ranking of quality and is not an endorsement. You must not describe Featured status as a certification by us.
Unless required by law, listing fees are non-refundable for the current period. You may cancel for the next period as described in the seller desk. We do not hold or transmit funds for the sale of goods.
6. Reviews and content
You keep ownership of content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content in connection with the Service. Reviews must be based on your own first-hand experience, must not be fake or compensated unless clearly disclosed, and must not be unlawful. We may remove content in our discretion. We do not endorse reviews or seller bios.
7. Prohibited use
You may not use the Service to:
- break the law, or sell items you don’t have the right to sell;
- scrape, spam, harvest accounts, or reverse-engineer the Service;
- impersonate anyone, or post malware or deceptive content;
- circumvent fees, badges, or search rules;
- interfere with other users or our systems.
8. No agency; independent parties
No joint venture, partnership, employment, or agency relationship exists between you and EstateSaleFinder LLC because of these Terms or your use of the Service. Sellers are not our workers. Households are not our clients for the sale of goods. Communications and contracts between users are solely between those users.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that a seller is licensed, insured, honest, or available; that items will sell or sell for any amount; that content is accurate; or that the Service will be uninterrupted or error-free. You use introductions at your own risk.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTATESALEFINDER LLC AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST GOODS, LOST DATA, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some states do not allow certain limits; in those states our liability is limited to the fullest extent allowed.
11. Indemnity
You will defend, indemnify, and hold harmless EstateSaleFinder LLC and its members, officers, and contractors from claims, damages, and reasonable attorneys' fees arising out of: your content; your items or the sale of your items; your actual or alleged lack of licenses; your agreement (or dispute) with another user; stolen or misdescribed goods; tax; or your breach of these Terms.
12. Intellectual property
The Service, the Sell My Stuff For Me name and mark, and our layouts are owned by EstateSaleFinder LLC or its licensors. You may not copy the directory or use our marks without written permission. If you believe content infringes your copyright, write to estatesalefinderai@gmail.com with the information required by the DMCA (17 U.S.C. § 512).
13. Termination
You may stop using the Service at any time. We may suspend or end access immediately if we believe these Terms were violated, if required by law, or if we stop offering the Service. Sections that by their nature should survive (including 8–11, 14) will survive.
14. Governing law; disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue for any court action that is not subject to small-claims court is the state or federal courts located in Pinellas County, Florida, and you consent to those courts. Before filing a claim, you agree to email us at estatesalefinderai@gmail.com and wait thirty (30) days so we can try to resolve it informally.
You and we each waive any right to a jury trial and to participate in a class, collective, or representative action, to the extent permitted by law. Either of us may bring an individual action in small-claims court in Pinellas County, Florida.
15. Changes
We may update these Terms. The “Effective” date at the top will change. Continued use after the new date is acceptance. If you do not agree, stop using the Service and cancel any paid listing.
